Data Protection Notice

Welcome

Holcim values you as its customers or as other persons who are interested in Holcim, our products, technologies and services. In the course of our mutual relations, we will collect and process some of your personal data. This Data Protection Notice explains how Holcim will use the personal data you provide us with and informs you of your rights and opportunities in this regard. The information concerns the Personal Data provided by you to Holcim and the data obtained on their basis. Usage information that is collected through cookies or other web tracking technologies is subject to our Cookie Policy, which can be found on the relevant Holcim web page.

Who is responsible for your personal data?

Your personal data will be controlled by the personal data controller: Holcim Polska S.A. with its registered office at Warszawska 110, Małogoszcz, Poland or by another entity associated with Holcim whose details will be provided in the correspondence you will receive; or by a group of entities that are joint controllers responsible for the security and integrity of your personal data. What purposes do we use your personal data for?

We will only process your personal data for the following purposes (“Permitted Purposes”):

  • Planning, conducting, managing and administering your (or those of a third party with whom you are affiliated) contractual business relationship with the Holcim Group, e.g. by executing transactions and orders for products or services, processing payments, carrying out accounting, auditing, clearing and collection activities, arranging shipments and deliveries, facilitating repairs, providing support services, and providing other services or things that you may have requested from us;
  • Maintaining the security and protection of our products, services and websites or other systems, preventing and detecting threats to security, fraud and other criminal or harmful activities;
  • Meeting compliance obligations, such as compliance checks or record-keeping obligations (e.g. under antitrust law, export laws, trade sanctions and embargo laws, anti-bribery and corruption laws and internal regulations, or to prevent misconduct in office and money laundering), which may include automated checking of your contact and identification details on relevant sanctioned persons lists and contacting you to confirm your identity in the event of a potential match, or recording of your interactions with third parties, which may be relevant for competition protection purposes;
  • Resolving disputes, pursuing the implementation of our contracts and agreements, and demonstrating the legitimacy, submission or defence of claims; or:
  • Ensuring compliance with legal requirements, e.g. regarding the keeping of sales records for tax purposes or sending notifications and other information as required by law.

We will not use your personal information to make any automated decisions about you or create profiles other than those described above.

The legal grounds for the processing of your personal data are contained in Article 6 of the EU General Data Protection Regulation. Depending on the above Permitted Purposes for which we use your personal data, their processing is necessary for the performance of a contract or other business arrangement with Holcim, or in order to comply with our legal obligations, or is necessary for the purposes of our legitimate interest, unless your interests, fundamental rights and freedoms are overriding. In addition, the processing may be based on your consent if it has been unequivocally given to us.

What personal data do we collect?

We may collect and process the following categories of personal data:

  • Contact information, such as your full name, company address, company phone number, company mobile number, company fax number, and company email address,
  • Payment data, such as the data necessary to process payments and prevent fraud, including credit and debit card numbers, security (authentication) code numbers, and other billing information;
  • Other business-related information necessary for processing as part of a project or contractual relationship with Holcim, or information voluntarily provided by you, such as orders placed, payments made, applications and projects;
  • Information collected from publicly available sources, data integrity databases, and credit rating agencies; and:
  • If required in order to comply with the law: information about relevant and important litigation or other legal proceedings against you or a third party related to you, and information about our relationship with you that may be relevant for competition protection purposes.
  • Special categories of personal data: in connection with registering for and providing access to an event or seminar, we may ask you for information regarding your health in order for us to determine and prepare for any disabilities and special dietary requirements you may have. Your consent is the basis for any use of such information. If you do not provide us with such information about disability and special dietary requirements, we will not be able to take appropriate precautions.
  • Other Personal Data: Occasionally, we may ask you to provide us with information about your date of birth, customs or preferences in order to send you messages with our wishes on days that are important to you. Your consent is the basis for any use of such information.

How do we collect personal data?

Primarily, we will collect your personal data directly from you. We do not obtain personal data from third parties except as set out herein (e.g. information from publicly available sources, data integrity databases and credit rating agencies).

How do we protect your personal data?

We maintain physical, electronic, and procedural safeguards in accordance with state-of-the-art technical requirements and data protection laws in order to protect your personal information from unauthorized access or hacking. These safeguards include implementing certain technologies and procedures designed to protect your privacy, such as secure servers, firewalls, and SSL encryption. We will always strictly comply with applicable laws and regulations regarding the confidentiality and security of personal data.

Who will we share your personal data with?

We may share your personal data with:

  • Companies affiliated with us in Holcim Group worldwide, where permitted by the law and to the extent necessary to carry out the Permitted Purposes. In such cases, these entities will then use the personal data for the same purposes and under the same conditions as those described in this Data Privacy Notice.   • Service providers (so-called data processors) within or outside the Holcim Group, at home or abroad, e.g. at joint service centres, instructed by us to process personal data for Permitted Purposes on our behalf and exclusively in accordance with our instructions. Holcim will retain control of and remain fully responsible for your personal information and will use appropriate safeguards as required by applicable law to ensure the integrity and security of your personal information when we engage such service providers.
  • Any courts of law, law enforcement agencies, regulators or lawyers, if legally permitted and necessary in order to comply with a legal obligation, demonstrate the validity of a claim, file a claim or defend a claim.
  • In other cases, we will only disclose your personal data when you have consented to it or instructed us to do so, when we are required to do so by applicable laws and regulations, when we receive an official or judicial request to do so, or when we suspect that fraud or criminal activity has occurred

Where do we process your personal data?

Holcim operates globally. In the course of conducting business, we may also transfer your personal data to recipients in countries outside the European Economic Area ("third countries") where the applicable law does not provide the same level of protection as the law in your home country. Your data protection rights

Subject to certain legal conditions, you have the right to request access to your personal data and to modify or delete it, and to restrict the processing of the personal data that concerns you. You also have the right to object to the processing and request the transfer of data. In particular, you have the right to request a copy of your personal data that we hold. If you use this option repeatedly, we may charge an appropriate fee. Please refer to Articles 15-22 of the EU General Data Protection Regulation (GDPR) for details on your data protection rights.

If you file any of the abovementioned requests, please use the contact details below to send us a description of the personal data in question and provide your full name and your customer number (or other Holcim identification number). We may require additional evidence from you to confirm your identity in order to protect your data from unauthorized access. We will carefully consider your request and may wish to discuss with you how best to comply with this request.

If you have given us your consent to the processing of your personal data, you can withdraw such consent at any time with effect for the future, i.e. the withdrawal of your consent does not affect the lawfulness of processing based on your consent prior to its withdrawal. In the event of withdrawal of consent, we may continue to process personal data where there is another legal basis for such processing.

If you have any concerns about how we treat your personal data or wish to make a complaint, you can contact us using the details provided below so that we can investigate the matter. If you are not satisfied with our response or believe that we are processing your personal data unlawfully, you can lodge a complaint with the competent data protection supervisory authority in your country.

What if I am under 18?

Persons under the age of 16 must obtain the consent of a parent/guardian before providing us with their personal data. Persons under 16 years of age are not allowed to provide us with their personal data without such consent.

Is it necessary to provide personal data?

As a general rule, you provide your personal data completely voluntarily; in principle, not giving your consent or not sharing your personal data does not have any negative consequences for you. However, in certain circumstances, Holcim cannot take action without certain personal data because, for example, this personal data is required to carry out legally required compliance checks. In such cases, if you do not give us your personal data, we may not be able to provide you with what you have requested from us.

Period of personal data storage

Your personal data will be deleted when there is no longer a reasonable requirement to keep it for the Permitted Purposes or when you withdraw your consent (if applicable), provided we are not required by law to continue to store such data or are otherwise entitled to do so. In particular, we will retain your personal data where necessary for Holcim to pursue or defend a claim, until the end of the relevant retention period or until the settlement of the claims in question.

Updates to this Data Protection Notice

This Data Privacy Notice was last updated in November 2021. We reserve the right to amend and revise this Data Privacy Notice from time to time to reflect changes in the way we use your personal information or changes in legal requirements. In the event of any such changes, we will post the revised Data Privacy Notice on our website or otherwise make it available.
